FDA Allows for Greater Access to Flavored Vapes
The Food and Drug Administration (FDA) delivered a major victory by expanding the number of tobacco harm reduction (THR) products that smokers can access to transition away from cigarettes. On May 5, 2026, the FDA issued its first marketing authorization of fruit-flavored electronic cigarette products, which overturns the 2020 ban on such products. The FDA also released guidance on May 12, 2026, to make it easier for other flavored THR products to receive approval in the future. These decisions promote personal choice and will expand the number of less harmful products that are available to smokers looking to ditch traditional cigarettes.
Citizens Against Government Waste (CAGW) has been promoting the benefits of THR products since November 17, 2016.
The revised guidance was adopted in part to assist the FDA in “efficiently allocating enforcement resources by focusing regulatory oversight on products that are more likely to meet the applicable public health standard.” The FDA stated that will increase the development and reduce the time needed to evaluate and make marketing decisions for THR products.
As CAGW noted, the FDA’s flavor ban and other restrictions on THR products led to a thriving black market. The number of different e-cigarette devices sold in the U.S. tripled since 2020 to 9,000 products. Many of these devices were unauthorized disposable vapes imported from China.
The FDA’s new and welcome approach will reduce the sale of illegal devices on the black market and comes as demand for e-cigarettes and other THR products continues to grow. Between January 2020 and December 2022, e-cigarette unit sales rose nearly 47 percent. Increasing the availability of THR produce will give smokers greater access to products that can help them quit and enable safe products to reach the market more quickly and efficiently.
THR products are less harmful alternatives that give smokers options when looking to ditch their smoking habit. By allowing more flavored e-cigarettes and other THR products to reach the marketplace, the FDA is improving public health, reducing the dangers of illicit products, and reducing costs for consumers and taxpayers.
