Shameful Circuit Court Decision Allows FCC to Control the Internet

(Washington, D.C.) – Citizens Against Government Waste (CAGW) today expressed outrage after the United States Court of Appeals for the District of Columbia Circuit issued a disturbing decision in favor the Federal Communications Commission’s (FCC) Open Internet Order (OIO), also known as net neutrality regulations.

The OIO is a prime example of the government overreach that has become rampant in the Obama administration.  Unfortunately, the court did not address the issue of federal overreach, instead relying on Chevron deference to decide that the agency has the authority to place the Internet under Title II of the Communications Act of 1934.

In ruling in favor of the FCC, the court has opened the door to further burdensome regulations on the Internet.  The OIO is just the beginning for an agency that has run amuck with FCC Chairman Tom Wheeler at the helm.  Going forward, the court’s decision will permit the FCC to promulgate increasingly arduous rules over the telecommunications industry, such as new, heavy-handed privacy rules. 

CAGW President Tom Schatz said, “Today, the court failed to protect consumers and taxpayers from further incursions on the Internet by the federal government.  A vibrant part of the economic growth of this country will now be constrained by federal regulatory burdens, confusing privacy rules, and slowed capital investments and innovations.”

Schatz further stated, “The court’s reliance on Chevron deference is troubling.  The case has continually been employed to justify abuse and overreach by executive branch agencies.  This issue can be rectified if Congress acts on the Separation of Powers Act or similar legislation.”
